It is essential that you notify our Claims Office immediately if a claim has been made against you or if any incident occurs that may lead to a claim against you.
Read the following instructions and fill out and submit an Incident or Claim Report to Physhield.
What kinds of communications should I report to Physhield's Claims Office?
Immediately notify our Claims Office of the following:
- Formal notice naming you as a defendant or a witness in a lawsuit
- Subpoena, summons, complaint or small claims court notice
- A request for a deposition or interview
- A request for arbitration
- Any verbal or written threat of legal action, such as an attorney's letter of intent to file a lawsuit or a demand for money or another form of settlement from a party alleging to be injured.
What kinds of incidents should I report to Physhield's Claims Office?
Report any incident related to a diagnosis or a treatment that could be construed as contributing to:
- Death
- Diminished life expectancy
- Birth injuries
- Loss of an extremity
- Injury to or impairment of a body organ
- Loss or impairment of any of the five senses
- Severe disfigurement
- Physical, verbal or written threats or harassment from a patient or family member
What other precautions should I take?
- Place the medical record in a safe place.
- Require the signature of the patient or the patient's legal representative to release a copy of the medical record or any information within it.
- Never add to, delete from, or in any way alter a medical record.
- After making a report to Physhield, keep copies of your correspondence and all related documents in a safe place. Do not keep this correspondence in the patient's chart.
- Do not make contact with anyone associated with the case except your Physhield Claims representative or defense attorney.
- Do not discuss the case with anyone other than your Physhield Claims representative or defense attorney.
How do I report an incident or claim to Physhield:
- Report an incident or claim in writing by immediately filling out our Incident or Claim Report and faxing or mailing it to the attention of Physhield's Claims Office.
- Reports may be faxed to 305-779-1778 or mailed to Physhield Claims Office, 700 S. Royal Poinciana Boulevard, Suite 506, Miami, FL 33166.
- Provide copies of all relevant documents (including any demand, notice of intent to sue, complaint, or other documents you receive that relate to the incident or claim).
- You may also wish to discuss the incident with Our Claims Office by calling 305-779-1740, but please be advised, this does not constitute notice to Physhield.
What can I expect once I have reported an incident or claim to Physhield?
When Physhield receives your written report, we will send you an acknowledgment and will carefully review your report. Then one of three things will happen:
- If no action is required following an incident, we will inform you that the report and medical records have been filed for reference in the event that a claim should follow.
- A claims representative may need more information from you and will contact you.
- In the case of a lawsuit or a demand for arbitration, we will send you an acknowledgment along with specific instructions. Our experienced claims experts and defense attorneys will provide a vigorous defense against nuisance suits or work with you to pursue fast and fair resolution for meritorious claims.
